Terms of Use

1. User's Acknowledgment & Acceptance of Terms

By completing your purchase of E-commerce Profit Plan, you are consenting to these terms and conditions. By accessing or using any part of this service, you agree to be bound by these terms without modification and acknowledge reading them.

2. Payments Details and Schedule

​

The Fee for the Program is $3,500 paid-in-full or 

​

• 2 payments of $1,750

• Or 6 monthly payments of $585

• Or 1 payments of $500 upfront + 24 weekly payments of $125
  ​

The Program Fee includes:

​

• Access to community portal with trainings for duration of enrollment;

• Access to monthly group coaching calls for duration of enrollment;
   

In consideration of the services provided by us to you as set forth above, you agree to pay us the current program fee at the time of joining as a one lump sum payment for six months of access or in monthly or weekly payments. If choosing to enroll in a payment plan, you understand that you will receive an email reminder for these payments. In the event that any authorized charge applied by us to your card fails, you remain responsible for payment as agreed herein, as well as any penalty fees as detailed below.

Failure to keep payments current will result in removal from the program.

​

In the event that you are enrolling with a discount/coupon code, you agree to the payment plan listed at checkout.

If paying by debit card or credit card, you give us permission to automatically charge your credit or debit card as payment for the program, product, service in agreement with your selected payment terms at checkout. In the event that payment fails, we will automatically attempt collection 4 times. After 4 failed payment attempts, your account will be marked delinquent and access will be revoked.

If you fail to make payment in a timely manner in accordance with these Terms of Use or voluntarily decide to withdraw from our programs, products or services at ant time or for any reason, you will remain fully responsible for the full cost of the programs, products or services.

All information obtained during your purchase or transaction such as name, address, method of payment, credit card number and billing information may be collected by both us and our payment processing company.

​

You agree to only purchase goods or services for yourself or for another person for whom you are legally permitted to do so or for whom you have obtained express consent to provide their name, address, method of payment, credit card number and billing information.

​

You agree to be financially responsible for all purchases made by you or someone acting on your behalf. You agree to use our programs, products, services or program materials for legitimate, non-commercial purposes only and not for speculative, false, fraudulent or illegal purposes.

 

3. Payment Options for the Full Program

Participants have the option to pay for the full program amount at checkout using Afterpay, Affirm, or Klarna. These buy now, pay later options cannot be used for our in-house monthly payment options. By selecting Afterpay, Affirm, or Klarna, participants understand they are committing to the full purchase amount of the program, with subsequent payments owed directly to these providers according to their terms and conditions. No refunds will be offered for payments made through these providers.

4. Refund Policy

Due to the digital nature of our products, all payments made during the program and subsequent payment plan are non-refundable. If you are not satisfied with your purchase, please contact us at support@theboutiqueacademy.com. However, refunds will not be provided under any circumstances.

By making a purchase you are agreeing to the terms of use and agreeing that no refunds will be honored. You are agreeing not to file a dispute or chargeback on any transaction or subscription charge associated with this purchase. In the event that a chargeback or dispute is placed, we reserve the right to report the incident to all three credit reporting bureaus or any other chargeback database that may have a negative impact on your credit score. Chargeback abusers wishing to be removed from the database shall make the payment for the amount of the chargeback.

5. Cancellation

 

To cancel your subscription, you must submit a request via email to support@theboutiqueacademy.com before your next billing date. Once processed, cancellations take effect at the end of your current billing cycle and program access will be automatically revoked at that time.
 

Subscription plans cannot be modified, transferred, or substituted once selected. If you cancel and wish to rejoin later, you must restart your subscription from the beginning at the current program rate.

No refunds will be issued under any circumstances. However, participants have the option to pay their full remaining balance early.

​

6. Commitment and Access Clause

By enrolling , participants agree to the full terms of the E-commerce Profit Plan, including all associated payments as outlined in the payment schedule. If participants are removed due to non-payment, they will not retain access to any program materials or assets. Lifetime access to program curriculum is only granted to those who pay their program fee in full.​

 

7. General Conditions

The Boutique Academy reserves the right to refuse service to anyone for any reason at any time. You expressly agree not to sell, resell, reproduce, duplicate, copy, or exploit any portion of this digital course or service provided without express written permission from us.

​

8. No Guarantees

We cannot guarantee any outcome from using the digital course, services, or participation in the program. Results are subjective and depend on factors beyond our control, including your level of participation and implementation.

 

9. Modifications to Terms

We reserve the right to update, change, or replace any part of these terms and conditions by posting updates on our platform. It is your responsibility to check periodically for changes. Continued use of the service after any changes constitutes acceptance of those changes.

10. No Lifetime Access
 

Participant understands that their enrollment in the Program is for a period of six (6) months unless otherwise stated.

11. Your License to Us

By posting or submitting material on or through our programs, products, services or program materials such as posts, comments, photos, images or videos you are representing that you are the owner of all such material.

​

When you submit to us any comment, post, image,  photo, video or other contribution, you are granting The Boutique Academy (and anyone authorized by The Boutique Academy) an unlimited, royalty-free, perpetual, worldwide license to use, copy, modify, or create derivative works from, distribute and/or publicly perform or display such contributions, in whole or in part, in any manner or medium. This does not include any of your own ideas. We will not take, borrow or steal any of your ideas or offerings for use in our own business.

12. Media Release

By participating in our programs, products or services and using our program materials, including our community, you consent photographs, videos and/or audio recordings that may contain you, your voice and/or your likeness. In our sole discretion we reserve the right to use the photographs, videos and/or audio recordings and any other materials submitted by you.

 

13. Personal Risk & Assumption of Risk

As a licensee/student/client, you agree that you are using your own judgement in using our programs, products and services as well as program materials. You agree that you are doing so at your own risk. Our programs, products and services as well as program materials are for informational and educational purposes only. You agree and understand that you assume all risks and no results are guaranteed in any way related to our programs, products or services.

You agree that you are solely responsible for your actions, decisions and results based on the use, misuse or non-use of our programs, products and services.

14. Legal & Financial Disclaimer

Our programs, products, services and program materials are not to be perceived or relied upon in any way for legal or financial advice. The information provided is not intended to be a substitute for services that would be provided by an accountant, lawyer or financial advisor. You agree that we are not responsible for your earnings, the success or failure of your business decisions or any decrease of your finances or income level. You agree that you are responsible for your results.

15. Earnings Disclaimer

You acknowledge that we have not and do not make any representation or claim of future income, expenses, sales volume, profitability or future benefits. We cannot and do not guarantee that you will attain a particular result, positive or negative, financial or otherwise.
